splitmaxx Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Max Thienel, the individual developer of splitmaxx ("we," "us," "the developer"), governing your use of the splitmaxx iOS app and splitmaxx.com (together, "splitmaxx" or "the Service"). By creating an account or using splitmaxx, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or at least 16 years old if you are located in the European Economic Area or United Kingdom, or the applicable minimum age of digital consent in your country if different) to use splitmaxx. By using the Service, you represent that you meet this requirement.

2. The Service

splitmaxx is a personal workout tracker: you log exercises, sets, reps, and weight, track streaks, and can optionally join a friend "ladder" (leaderboard) built around a specific lift.

splitmaxx is currently a free public beta. There is no monetization, no in-app purchases, and no subscriptions at this time. This means:

  • Features may be added, changed, or removed at any time without notice.
  • The Service may experience bugs, downtime, or data loss more often than a finished, released product.
  • We make no commitment about future pricing, premium features, or when (or whether) any particular feature will become permanent.

If we introduce paid features in the future, we will update these Terms and notify you before any charges apply.

3. Your Account

You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@splitmaxx.com if you suspect unauthorized access to your account.

You may sign up using email/password, Sign in with Apple, or Google Sign-In. You're responsible for keeping the underlying Apple ID or Google account secure if you use those options.

4. Acceptable Use

You agree not to:

  • Use splitmaxx for any unlawful purpose or in violation of these Terms;
  • Harass, abuse, or impersonate other users, including within shared ladders;
  • Attempt to gain unauthorized access to the Service, other users' accounts, or our systems;
  • Interfere with or disrupt the Service or its infrastructure;
  • Submit false workout data with the intent to manipulate ladder standings in a way that misleads other users;
  • Reverse-engineer, decompile, or attempt to extract the source code of the app, except as permitted by applicable law.

We may suspend or terminate accounts that violate these rules.

5. Your Content

You retain ownership of the workout data, display name, and any other content you submit to splitmaxx ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive license to store, process, and display it as necessary to operate the Service — for example, showing your display name and standings to other members of a ladder you've joined, or backing up your workout data to the cloud if you enable that feature.

6. No Medical Advice

splitmaxx is a workout-logging tool. Nothing in the app constitutes medical, health, or fitness advice. splitmaxx does not diagnose, treat, or provide guidance on any medical condition, and workout data, streaks, or ladder standings should not be interpreted as medical or professional fitness guidance. Consult a qualified physician or fitness professional before beginning any exercise program, especially if you have a pre-existing health condition. You use splitmaxx, and any exercise program you track with it, entirely at your own risk.

7. Third-Party Services

splitmaxx uses third-party services to operate (including Supabase, PostHog, Sentry, Resend, Apple, and Google, as described in our Privacy Policy). Your use of Sign in with Apple or Google Sign-In is also subject to those companies' own terms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT YOUR DATA WILL NEVER BE LOST.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. BECAUSE SPLITMAXX IS PROVIDED FREE OF CHARGE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED FIFTY U.S. DOLLARS ($50).

Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Termination

You may stop using splitmaxx and delete your account at any time from within the app. We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Sections 5, 6, 8, 9, 11, and 12 survive termination.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in the State of New York, and you consent to personal jurisdiction in those courts. (These Terms do not require arbitration.)

If you are a consumer residing in the EU, UK, or another jurisdiction that grants you the benefit of mandatory local consumer-protection laws, this section does not deprive you of the protection of those mandatory provisions.

12. Changes to These Terms

We may update these Terms from time to time, particularly as the beta evolves. If we make material changes, we'll update the "Last updated" date and, where appropriate, provide additional notice (such as an in-app notice). Continued use of splitmaxx after changes take effect means you accept the updated Terms.

These Terms do not yet address Apple Watch/HealthKit features or paid subscriptions, because splitmaxx does not currently offer either. Terms for in-app purchases/subscriptions (including required auto-renewal, pricing, and cancellation language) will be added before any premium tier launches.
